The IND has already fined Nina Care about 50 times for a total of 110,000 euros. Although Nina Care submitted an improvement plan, the IND determined that the company had not demonstrated sufficient willingness or ability to change. The IND cited two years of repeated breaches of the rule as the basis for its decision to cancel Nina Care's license.
Response from Nina Care
Agency owners, Lyla and Jasmijn Kok, state they appreciate and support the IND's position and decision. They stressed that they approach the business with honesty and transparency, and will work to ensure that both families and au pairs can work towards an acceptable outcome. Although Nina Care can no longer bring au pairs from outside the EU, they will continue to recruit candidates from the EU/EEA member states.
At this moment, hundreds of au pairs working in the Netherlands are doing so through Nina Care. Periodically, those au pairs working for Nina Care and from outside the EU who have less than three months left to stay in the country can finish the remaining time. However, those au pairs with more than three months left will need to move on to another agency. The IND will hold an information session and send letters to host families of au pairs explaining what the next steps should be.
Future of Au Pair Recruitment
The IND clarified that Nina Care can still recruit au pairs and place them from within the EU, as that falls outside of their supervision. In cases such as if/what oversight occurs, it may come from another organization, such as the Labour Inspectorate, potentially if there is risk or complaints about businesses. The implications for Nina Care in the future are still unknown, and closer monitoring may occur.
